Terms & Conditions
Definitions
a) Provider: Refers to Raven BVBA, Excelsiorlaan 16, B-1930 Zaventem, Belgium (BE0663.545.920).
b) User: Refers to any person, consumer, or business customer who uses the services offered by Raven BVBA.
c) Consumer: Any natural person who acts for purposes outside of their commercial, business, craft, or professional activity.
d) Business Customer: Any user who is not a consumer.
e) Services: Includes providing spaces in which the "escape room" game concept and the concept of Virtual Reality can be practiced, "Event Space" suitable for a wide range of events such as business meetings, social events, and private parties, "Party Hall" A spacious and adaptable hall for organizing parties, receptions, and other celebrations, including catering and decoration options, using materials provided by the Provider.
f) Presumed Amount Due: The amount the User would owe Raven if the requested services had taken place, calculated based on the posted rates or based on the issued quotes, both in accordance with the specifications communicated by the User at the time of the reservation and/or the request for a quote.
Applicability
– These terms and conditions apply to every offer and every agreement or contract with this company for the services of the company.
– Any general conditions of a user towards the provider are explicitly considered not applicable and can only be individually applicable if the provider has explicitly accepted them in writing and in advance.
– The user who accepts the offer of the provider under these Terms & Conditions also accepts these Terms & Conditions as the applicable conditions for all future agreements and for all services provided by the provider.
Interpretation
– The Terms & Conditions shall be interpreted in accordance with Belgian law.
– If one or more provisions of these Terms & Conditions are found to be contrary to Belgian law, the remaining provisions will still apply in full.
Payment
– Payment for services must be made, unless otherwise agreed or stated on the invoice, upon the completion of the use of the services, at Raven’s premises, solely through cash payment, either in cash or electronically.
– Unless there is prior written agreement from Raven, no other method of payment will be accepted as valid. The business customer of Raven will receive an invoice for the services rendered, which will indicate the due date, which will not exceed 15 days after the invoice date.
– In the case of non-payment by the due date of the invoice, default interest will be owed at a rate of 10% per year without further notice and the invoice amount will be increased by 5%, with a minimum of €50.
– The same interest will be owed if Raven has to make payments to the User, following prior notice of default.
Reservation and Cancellation
Cancellation Terms:
Small Groups (up to 20 persons):
– Catering adjustments: Possible up to 4 days before the event. After that, 100% of the catering costs are due.
– Cancellation terms: – Up to 48 hours before the event: Free adjustments up to 4 persons, otherwise 100% payment required. – 1 week before the event: 75% of the costs are due. – 2 weeks before the event: 50% of the costs are due.
Medium Groups (21 to 40 persons):
– Catering adjustments: Possible up to 5 days before the event. After that, 100% of the catering costs are due.
– Cancellation terms: – Up to 48 hours before the event: Same conditions as for small groups. – 1 week before the event: 75% of the costs are due. – 2 weeks before the event: 50% of the costs are due.
Large Groups (41 to 80 persons):
– Catering adjustments: Possible up to 2 weeks before the event. After that, 75% of the catering costs are due.
– Cancellation terms: – Up to 48 hours before the event: Same conditions as for small groups. – 1 week before the event: 100% of the costs are due. – 2 weeks before the event: 50% of the costs are due.
Very Large Groups (more than 80 persons):
– Catering adjustments: Possible up to 2 weeks before the event. After that, 75% or 100% of the catering costs are due, depending on the situation.
– Cancellation terms: – Up to 48 hours before the event: Same conditions as for small groups. – 1 week before the event: 100% of the costs are due. – 2 weeks before the event: 50% of the costs are due.
Liability
– Raven will not be liable for any damage of any kind arising from the following circumstances: – Force majeure; – Malfunction of provided equipment; – Theft from Raven’s premises; – Strikes; – Damage resulting from medical conditions that were not reported in advance; – Government orders.
– Raven will only be liable for damages if the user proves that Raven acted intentionally incorrectly or made gross mistakes in providing the services. In all cases, Raven’s liability is limited to direct damage per incident in accordance with its business policy at KBC. The user waives any claim for compensation in cases where the damage does not exceed two hundred euros. The user waives the first two hundred euros for any claim for compensation that exceeds two hundred euros.
Jurisdiction and Authority
– The agreement between Raven and the User is governed by Belgian law. Only the Dutch-speaking courts of the Brussels district or the Justice of the Peace of Zaventem are authorized to handle any disputes concerning the execution of the agreement or these terms and conditions.
